城乡建设用地同权同价改革困境及实现路径论析

Abstract

In this paper, we discussed that urban-rural dual land system and the land expropriation resulted by the current dual property rights of urban-rural construction land had brought the reform of same right with same price many institutional dilemmas and realistic questions. In order to promote the reform, we must have the state own all the lands' property and establish transitional mechanism, which includes constructing the transformational system of rural collectional public construction land, commercial construction land, and homestead; implementing reform measures of shared ownership, multiple premium payment and the land premium capture; protecting the rights of users and owners.
